EVALUATION PROCEDURE

  • The grant of Licence to a manufacture to certify their product under the Certification Scheme operated by EMTAC is determined by the results of conformity assessment through preliminary evaluation.
  • This includes scrutiny of the documents provided by the applicant along with the application and a preliminary assessment at the applicant’s premises to assess the applicant’s capability to consistently manufacture and control quality of the product considered for certification.
  • Subject to all assessment hereto being satisfactory, a sample shall be drawn for independent testing at EMTAC’s laboratory. Applicant shall submit the engineering drawings of all the varieties/types/sizes that they intend to cover under the certification Licence.
  • Provided the sample conforms to all the requirement of the specification and additional requirements, as may be specified in the scheme and the applicant has fulfilled all other conditions, the case shall be taken up for grant of license.
  • In case the sample fails in testing, the applicant will be advised to submit a fresh sample for testing. If the second sample also fails the application will be rejected. The applicant may apply afresh once again after ensuring improvement in the product.

TERMS AND CONDITIONS

General and particular requirements for obtaining and operating the EMTAC Certification Mark Licence are given in the following four documents all of which have to be accepted by the manufacturer desirous of obtaining the Licence.

PROCEDURE FOR CHANGES IN CERTIFICATION SCOPE

All changes affecting certified products shall be addressed and evaluated by EMTAC to ensure continued compliance with the certification scheme. The changes and procedures for effecting these changes are given under:

Extension of Scope Follow the procedures similar to initial application for product certification. The Chief Of Certification is empowered to decide whether any step in the procedure may be waived. The technical rationale behind any such decision shall be recorded and placed to CEO for review and endorsement. The CAB will be appraised. Appropriate endorsement to be made in the Licence document.
Requests from licensee for approval of changes to certified products
  • Evaluate changes to ensure conformity
  • Take appropriate actions to acknowledge and ensure conformity to new documents
Submit a written request to EMTAC along with documentation and/or proposed drawings showing these changes, with evidence of continued conformity Not Applicable

STOPMARKING AND TERMINATION OF LICENCE

  • EMTAC will conduct at least two surveillance audits during one operative year. During the surveillance visit, the auditor will verify the compliance to the conditions of operation of the Licence.
  • Sample shall only be drawn from certified product. In case of failure of a sample during the surveillance, the licensee shall be immediately informed of the failure and advised to take corrective action within a month or the next production whichever is earlier.
  • The corrective actions documented by licensee will be reviewed by COC and necessary modifications shall be made in the relevant documents by the licensee.
  • In the event of this sample also failing to comply with the requirements of the standard, the case shall be put up to COC for consideration of Stop-Marking.
  • The stop marking instructions shall be revoked on verification of adequacy of corrective actions taken by the licensee. Such verification may involve testing of a sample. Wherever possible the verification and/or testing shall be done at the licensee’s premises to speed up the process.
  • On receipt of stop marking instructions, the licensee shall forthwith discontinue use of the labels and officially confirm compliance. Continuation of use of labels will be considered a deliberate violation of the conditions of the Licence and may invite serious deterrent actions like termination of Licence.
  • The validity of a Licence may be terminated at the end of an operative period(non-renewal) or during an operative period (cancellation) .

A Licence may be cancelled in the following manner;

  • Licensee withdraws Certification (90 days prior notice to be served to EMTAC)
  • In the event of EMTAC determining a serious violation of the conditions of the Licence, the Licence may be cancelled forthwith without any notice
  • Licence may be terminated by EMTAC, upon Non- payment of financial dues to EMTAC (A prior notice of 30 days will be given by EMTAC to the licensee).
  • In case, the product fails to meet the requirements of the standard Licence may be terminated with a 30 days prior notice by EMTAC.
  • Non- submission of Renewal Application within specified period by Licensee may also lead to termination and no notice need be given by EMTAC in this event, as the Licence already ceases to exist beyond the validity period.
  • In the event of non- renewal of Licence by EMTAC, there shall be no notice as the Licence already ceases to exist beyond the validity period. However, a decision will be conveyed to Licensee within 7 days of submission of Renewal Application.
